- 전세사기 예방을 위한 공인중개사의 역할과 개선방안 -
최근 정부는 전세사기의 피해를 예방하고 직접적인 원인을 파악하여 빠른 해결을 위해 피해자들에게 저금리로 대출을 해주거나 공공임대주택에 거주할 수 있는 자격을 부여하 는 대책을 발표하였지만, 주도적이고 단기적인 대책 위주로 시장의 자정 능력을 통한 대 책이 필요하였다. 이에 본 연구는 전문가의 자정 능력을 바탕으로 정책을 제시할 목적으 로 전문가집단을 구분하여 분석하였다. 분석 결과, 중개대상물의 확인⋅설명과 임차인의 재산권 보호를 위한 제도를 개선해야 한다. 둘째, 전문가집단이 한국공인중개사협회는 부 동산 매물 및 시세 등 정보를 제공하는 체계를 구축하여 국민의 알권리와 정보의 비대칭 을 해소하는 의무를 수행해야 한다. 셋째, 전문가의 직업윤리 제고를 위해 자율적이고 객 관적인 윤리규정을 개선해야 한다. 넷째, 전문성 향상을 위한 교육시스템을 개선해야 한다. 이를 위하여 실무교육과 전문교육 및 연수 교육에 대한 프로그램을 실무에 맞게 보완 해야 한다. 이를 통하여 투명한 직업윤리와 전문성이 강화된 전문가와 정보의 비대칭을 최소화하여 국민의 신뢰를 극복해야 한다.
A role and improvement plan of professional qualifications to prevent jeonse fraud
Recently, the government announced measures to prevent the damage from lease fraud identify the direct cause and quickly resolve it by providing low-interest loans to victims or granting them eligibility to live in public rental housing. However, market-based measures through the market’s self-regulation ability were needed, rather than proactive and short-term measures. For this purpose, this study analyzed the expert group by dividing it into groups to suggest policies based on the self-regulation ability of experts. As a result of the analysis, it is necessary to improve the system for verifying and explaining the mediation target and protecting the property rights of tenants. Secondly, the Korea Association of Realestators provide information such as real estate listings and prices, establish a system to provide information, and perform the duty of resolving the right to know and information asymmetry of the people. Third, it is necessary to improve the self-regulatory and objective ethical standards to enhance the professional ethics of experts. Fourth, it is necessary to improve the education system to enhance professionalism. To this end, the programs for practical education, professional education, and training education should be supplemented to suit the practice. Through this, transparent professional ethics and professionalism should be strengthened, and information asymmetry should be minimized to overcome the trust of the people.
