- 아파트 분양제도 및 전매에 관한 연구 - 캐나다제도와 비교분석 -
본 연구는 한국의 신규 아파트 분양과 전매제도의 고찰을 통하여 부족한 점을 도출하고 캐나다의 신규 주택 분양과 전매제도에 대한 비교 분석을 통하여 한국의 신규 아파트 분 양과 전매제도의 선진화를 지향 할 수 있도록 하였으며, 특히 신규주택에 대한 보증보험의 중요성에 대한 고찰을 하였다. 연구결과, 입주자모집공고는 각 국가별 사회 환경에 따라 다르지만 분양회사는 분양과 입주에 대한 책임과 의무가 있게 된다. 한국에서 전매는 주요도시에서 법적으로 금지되어 있다. 그러나 신규 아파트의 입주권 및 분양권의 전매는 여전히 존재하며 일부 부동산중개 인들은 불법 전매로 인해 검거되기도 한다. 전매는 적절한 절차에 따라 가능하도록 해야 하며, 분양회사가 준비한 전매계약서에 양도인과 양수인, 부동산중개사가 서명하고 분양회 사의 승인을 받도록 해야 한다. 이에 따라 전매차액은 양성화되고 특별소득세의 부과 대상 이 되어야 한다. 신규주택의 보증과 관련하여 보증회사는 일반인에게 신규주택 보증프로 그램에 포함된 구성요소와 각 세부작업을 검토하고 이해할 수 있도록 상세 지침 책자를 배포할 수 있어야 한다.
Pre-construction Apartment sales and Assignment-approach with Canadian System
This study aims to derive the shortcomings and to enhance the pre-construction apartment sales and assignment system in Korea through a comparative analysis of the Canadian system. In particular, all the element of the new home warranty insurance should be in the arms reach of the public and be detailed. As a result, the recruitment advertizement differs depending on the social environment of each country. The developers have responsibilities and obligations to recruit, but the assignment is legally prohibited in Korea. The resale of the right to occupancy or move-in the pre-construction apartment still exists and some of real estate agents were said to be arrested because of the illegal assignments. It needs that the assignment be allowed with the proper procedure including the Agreement form be prepared by the company and be signed by both the assignor and assignee and the real estate agents(if needs) as well, and to be approved by the developer. The gain shall be exposed and subjected to the special income tax. With respect to the new home warranty, the warranty company should prepare guideline booklets in order for the ordinary people can review and understand what components and works are included in the new home warranty programs.
