- 공익사업에 있어서 수용제도의 문제점과 개선방안 -
본 연구는 공익사업에 있어서 수용제도 문제점을 제시하고 외국의 토지수용제도를 비교 평가하여 개선방안을 다음과 같이 도출하고자 하였다. 첫째, 사업인정 요건의 강화가 필요 하다. 토지소유자에게는 재산권 차원에서 일단 사업이 인정되면 수용이 허용되기에 그 요 건은 구체화되고 엄격히 적용되어야 한다. 둘째, 사업인정과정에서 이해관계인의 참여가 보장되어야 한다. 만일 참여의 기회가 부족하다면 권리보호 측면에서도 문제가 될 수 있다. 셋째, 사업인정 의제규정은 입법적인 보완이 필요하다. 그 이유로 사업인정 의제로써 수용 권의 행사가 남용된다면 재산권 침해가 될 수 있기 때문이다. 넷째, 개발이익배제의 원칙은 공평적인 접근이 필요하다. 즉 헌법의 평등 원칙으로도 문제가 되며 따라서 개발이익배제 와 개발이익환수 간에 공평성을 유지할 수 있도록 제도적 개선이 바람직하다. 다섯째, 보상 협의절차에서 운영되는 보상협의회가 피수용자에게 실질적인 권익보호의 역할을 다할 수 있도록 보완이 필요하다.
The Problems and Improvement Alternatives with Condemnation System in Public Utilities
In this study, we presented the problem of detention system in public utilities, and tried to derive the improvement alternatives as follows by comparing and evaluating foreign land expropriation systems. First, business certification requirements need to be strengthened. If a landowner is allowed business in the ownership dimension, the accommodation should be permitted, the requirements should be embodied and strictly applied. Second, stakeholder participation must be guaranteed in the process of accreditation. If there are not enough opportunities for participation, it may be a problem in terms of rights protection. Third, the provisions on the agenda for business accreditation need to be legislatively supplemented. This is because there is a possibility of infringement of property rights if an expropriation event is abused as an agenda for business certification. Fourth, the principle of eliminating development profits requires a fair approach. In other words, there is a problem with the constitutional equality principle. Therefore, institutional improvements are desirable so that development profits can be eliminated and development profits can be kept fair. Fifth, supplementation is necessary so that the compensation council operated in the procedure of the compensation council can play a role in protecting detainees substantial interests.
