- 상가건물임대차보호법에서 임차인의 해지통고기간에 관한 연구 -
최근 상가건물임대차보호법의 지속적인 개정으로 임차인의 지위 보호는 강화되었지만, 실제 상가 임대인과 임차인의 분쟁에 관한 상담 및 조정신청 건수는 늘어가고 있는 추세이 다. 본 연구는 외국의 임대차 관련 법률과 우리의 민법 및 주택임대차보호법의 해지 조건 및 통고 기간의 형태를 분석하여 상가건물임대차보호법상 해지통고 효력 발생기간과 차이 를 비교하여 검토하였다. 검토결과, 상가건물임대차보호법상 임차인의 계약종료 전 종료일에 해지하겠다는 통고 는 당사자 일방의 통지로 법률효과가 성립되는 형성권이라고 볼 수 있다. 또한, 상가건물임 대차보호법상 임차인의 해지통고 기간이 명시되어 있지 않아 계약 종료를 앞둔 임대인의 지위가 이행지체 상태로 빠질 수 있고, 해지의 효력을 두고 다툼의 소지가 있다. 따라서 상가건물 임대차 계약에서는 임대인의 해지통고 기간을 현재의 최소 1개월 전보 다 더 긴 시간적 여유를 주어야 하고, 또한 임차인의 해지통지 기간 및 효력 발생일도 명문 화 해 상가임대차 계약이 안정을 추구하도록 법률 규정의 개정을 강력하게 검토해 보아야 한다.
A Study on the Termination Notification Period of the Tenant in the Commercial Building Rental Protection Act
The protection of tenants' status has been strengthened recently by the continuous revision of the Commercial Building Rental Protection Act, but the number of counseling and mediation applications for conflicts between real-world tenants and renters is increasing now. This study was reviewed by comparing the difference between the effective period of annulment notification in the Commercial Building Rental Protection Act and the period of notice period and the terms of termination in the Foreign Rental Act and the Housing Rental Protection Act. As a result of the review, the notice in the Act that the tenant's contract is terminated at the end date before the termination of the contract is regarded as the right to form a legal effect upon notification by either party. In addition, the Act does not specify the period of notice of termination of the tenant, so the status of the tenant facing termination of the contract may fall into a status of performance delay, and there may be disputes over the effect of termination. Therefore, the lease contract of the commercial building should give the tenant a longer time to notify the termination than the current minimum one month, and the revision of the legal regulation should be considered to ensure that the lease contract is stable by specifying the period of notice of termination and date of effect of the tenant.
